Your most powerful tool. Under the EPA 1990, your local council has a legal duty to investigate a statutory nuisance complaint — not merely discretion. Smoke entering your home qualifies if it unreasonably interferes with your use and enjoyment of your property. Process: document for 2–4 weeks, try informal approach with neighbour, report to council's Environmental Health department, council issues Abatement Notice if nuisance confirmed, breach of Abatement Notice is a criminal offence with fines up to £5,000.
Tenancy Agreement and Landlord Route
If you and the smoker share a landlord, most tenancy agreements prohibit causing a nuisance or interfering with quiet enjoyment. Write to your landlord (keep a copy), describe the problem, reference the nuisance clause, attach your evidence log, and request formal written warning to the smoking tenant and action within 14 days. If inadequate response, escalate to Environmental Health or the Property Redress Scheme your letting agent is registered with.
Homes (Fitness for Human Habitation) Act 2018
If persistent smoke ingress has made your property uninhabitable and your landlord has failed to act, you may have a civil law claim under this Act. The Renters' Rights Bill (introduced 2024) proposes to abolish Section 21 no-fault evictions, making it safer for tenants to complain without fear of retaliatory eviction.
